Significant Data Fiduciary status isn't self-declared — the government notifies entities based on factors like volume of personal data processed, sensitivity of that data, and the risk to electoral democracy or state security. But that doesn't mean it's unpredictable.

The factors that matter

  • Volume and sensitivity of personal data processed, including children's and health data
  • Risk to India's sovereignty and integrity from a breach of that data
  • Potential impact on electoral democracy, state security, or public order
  • Impact on the rights of Data Principals at scale

If you're processing health data, financial data, or children's data at meaningful scale, it's worth preparing for SDF obligations before notification, not after. A Data Protection Impact Assessment and an appointed DPO both take longer to stand up properly than the runway you'll get once notified.
